If you own property in Greece and are considering selling it, one of the first questions is usually: Will I pay capital gains tax in Greece?

Capital Gains Tax Is Currently Suspended

The application of the Greek capital gains tax provisions for transfers of real estate by individuals is currently suspended until 31 December 2026.

When Can Property Sales Become Business Activity?

A different issue arises when a person systematically buys and sells properties with the intention of making a profit.

Greek tax legislation provides that three similar real-estate sale transactions within a two-year period can constitute systematic activity.

Importantly, the analysis is more nuanced than simply counting properties.

For example, sales of assets acquired through inheritance, or by gift from relatives up to the second degree, or assets held for more than five years, are specifically treated differently for this purpose.

The circumstances and the intention to generate profit are important.

Buying properties specifically to resell them for profit cannot automatically be treated as ordinary private property disposal simply because the seller has not formally opened a business.

What If I Live Abroad?

This is extremely important for international owners.

The fact that no Greek capital gains tax is charged does not automatically mean that no tax is due anywhere.

If you are tax resident in another country, the sale may also need to be reported there.

Your tax treatment depends on:
  • the domestic law of your country of tax residence;
  • the Greece–country Double Taxation Agreement, where applicable;
  • the nature and circumstances of the transaction.
Before selling Greek property, a non-resident should therefore review the transaction from both the Greek and foreign tax perspective.
